Terms of Service

These Demo Gift Promotion Terms & Conditions (“Promotion Terms”) apply to Everstage Inc.’s (“Everstage,” “we,” “us,” or “our”) limited-time demo gift promotion (“Promotion”). By registering for, attending, or participating in the Promotion, you agree to these Promotion Terms.

1. Promotion Overview

Eligible participants may select one available gift after attending and completing a scheduled live Everstage demo. Available gifts may include AirPods, an Ember Mug, a Therabody massager, or another gift of comparable value, subject to availability.This Promotion is not a sweepstakes, contest, lottery, or game of chance. Gifts are issued only to eligible participants who satisfy the requirements stated below.

2. Eligibility

To be eligible, participants must:

Be at least 18 years old. Be located in the United States and provide a valid United States shipping address. Register using a valid business email address. Personal email domains are not eligible. Attend and complete a scheduled live Everstage demo. Be a business professional who has a reasonable business interest in evaluating Everstage’s products or services. Provide accurate registration, attendance, and shipping information. The Promotion is limited to one gift per person and one gift per company, unless otherwise approved by Everstage in writing. Employees, contractors, officers, and representatives of Everstage, its affiliates, competitors, advertising or promotional agencies, and their immediate family members are not eligible. Government officials, public sector employees, healthcare professionals, and any person subject to gift restrictions may be excluded at Everstage’s discretion.

3. How to Qualify

A gift is issued only after the participant attends and completes the scheduled live demo. Registering, booking, rescheduling, or joining briefly does not qualify a participant for a gift. Everstage reserves the right to verify eligibility, demo attendance, company affiliation, business email validity, and compliance with these Promotion Terms before approving fulfilment.

4. Gift Fulfillment

Approved gifts will be shipped to eligible United States addresses only, typically within 5 business days after the completed demo and verification, subject to availability and fulfillment timelines.No cash alternative, refund, transfer, or substitution by the participant is permitted. Everstage may substitute any gift with another item of equal or greater value if the selected item is unavailable. Everstage is not responsible for fulfilment delays caused by shipping carriers, incorrect or incomplete shipping information, recipient unavailability, weather, customs or logistics issues, or other events outside Everstage’s reasonable control.

5. Compliance With Employer Policies

Participants are solely responsible for confirming that accepting a gift complies with their employer’s policies, codes of conduct, procurement rules, anti-bribery rules, and any other applicable restrictions. By selecting or accepting a gift, the participant represents that they are permitted to receive it and that acceptance will not violate any applicable law, regulation, contractual obligation, or employer policy. Everstage may refuse, cancel, or withhold a gift if it believes fulfilment may violate applicable law, professional rules, employer policies, or the integrity of the Promotion.

6. Taxes

Any taxes, reporting obligations, or other costs associated with accepting a gift are the sole responsibility of the recipient. The gift value may be reportable as taxable income depending on applicable law or the recipient’s employer policy. Participants should consult their own tax advisor with questions.

7. Promotion Period

The Promotion runs from Sep 1, 2026 to Oct 31, 2026 or while supplies last, whichever occurs first. Everstage may modify, suspend, extend, or terminate the Promotion at any time, with or without notice. The Promotion is void where prohibited or restricted by law.

8. Privacy

Information collected in connection with the Promotion may be collected, used, processed, and retained by Everstage for purposes including administering the Promotion, scheduling and conducting demos, verifying eligibility, fulfilling gifts, communicating with participants, and conducting sales, marketing, analytics, and other related business activities, in each case in accordance with Everstage’s Privacy Policy.

9. Disqualification

Everstage reserves the sole right, in its discretion, to disqualify any participant for any reason, including where Everstage determines that the participant has provided false or misleading information, used multiple identities or email addresses, attempted to circumvent eligibility requirements, failed to complete the demo, engaged in abusive or fraudulent conduct, or otherwise failed to comply with these Promotion Terms.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Everstage will not be liable for any direct or indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to the Promotion or any gift.

11. Governing Law

These Promotion Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
